Last Updated: June 19, 2024

  1. Welcome to originalwheeler.com ("we," "us," or "our"), the official online gallery of artist Drew Wheeler (“Original Wheeler”, “originalwheeler.eth,” or “ORGNLWheeler”). We are dedicated to safeguarding your privacy and managing your personal information with care and respect. This Privacy Policy outlines our data collection, usage, and protection practices.

  1. Data Collection
    1. Use of Collected Information: The information we collect is voluntarily given by users of our services and facilitates the primary sales of artworks, supports communication between NFT owners and the artist, and allows prospective collectors to inquire about artworks.
  1. Types of Information We Collect.
    1. During the primary sale of artworks and NFTs, as well as when messages are left by the current owner of an NFT, we collect personal information necessary to complete the sale and to facilitate communication between the artist, collectors, and prospective buyers. This information may include but is not limited to your name, email address, shipping address, billing information, and Ethereum blockchain address.
    2. Messages. Messages left by the NFT's current owner on our platform are also collected and displayed as part of the artwork's provenance and community engagement features.
    3. Feedback. If you provide us with feedback or contact us, we may receive your name and contact information (such as an email address), as well as any other content included in or associated with the message you send.
    4. Other Information. We also collect information and other data at other points in our Service where you voluntarily provide it or where we state that your information is being collected.
    5. Additionally, like much of web3, your blockchain wallet address functions as your identity on originalwheeler.com. Accordingly, you will need a blockchain wallet address and a third-party wallet to access certain aspects of the Service. We do not consider a blockchain wallet address, standing alone, to be information that identifies you. However, a blockchain wallet address may become associated with you or information you provide when you use our Service.

  1. Artwork/NFT Purchases and Third-Party Services
Our Service may contain links to third-party websites. When you access the embedded Darkblock.io viewer or click on a link to any other website or location, you will leave our Service and go to another site, and another entity may collect information from you. We have no control over and cannot be responsible for these third-party websites or their content. Please be aware that this Privacy Policy does not apply to these third-party websites or their content, or to any collection of your information or information about you after you click on links to such third-party websites. We encourage you to read the privacy policies of every website you visit. Any links to third-party websites or locations are for your convenience and do not signify our endorsement of such third parties or their products, content, or websites.
  1. Purchases of artworks and associated NFTs are conducted on the OpenSea.io marketplace. For additional services requested through the Primary Sale Shipping Form on our website, payments in USDC must be made to the artist's associated Ethereum ENS address: originalwheeler.eth (0xe9f1cAB4559B44fA908Ad113841c540056b08082).

  1. We use third-party services like, Darkblock.io, Etherscan.io API (to retrieve blockchain data), Bueno.art Forms (to capture and store primary sale shipping information), Converse Messenger and other XTMP messaging clients, and shipping providers (FedEx, UPS, DHL) to support these activities. We recommend reviewing their privacy policies to understand their practices, as we do not control these platforms.

  1. Third-Party Wallets: to use certain aspects of our Service, you must use a third-party wallet which allows you to engage in transactions on public blockchains. Your interactions with any third-party wallet provider are governed by the applicable terms of service and privacy policy of that third party.

  1. Responsibility for Content and Transactionssome text
    1. We are not responsible for the content of messages posted by users or communication between users via XMTP or the transactions on the Ethereum blockchain, Darkblock.io, Etherscan.io, Bueno.art, shipping providers, or OpenSea.io. Users are responsible for their content and transactions, adhering to the terms and policies of each service.

  1. Users may leave messages on our platform associated with their NFT ownership. While we provide the space for such messages to be left, the content of the messages is the sole responsibility of the individual who posted the message. originalwheeler.com is not responsible for monitoring or moderating the content of user messages and does not assume liability for any messages posted by users. We reserve the right to remove any content that we determine to be inappropriate, offensive, or in violation of our terms of service.
